Terms and Conditions

Welcome to Mapster ("we", "our", or "us"), a platform for creating and running surveys on your website or inside your product, sharing surveys via links, and analyzing the responses, including responses linked to your users' identity and attributes when you choose to provide them. These Terms and Conditions ("Terms") govern your use of Mapster's website, services, and platform (collectively, "Services").

Mapster is operated by Galaxy Labs Limited, a company registered in New Zealand (company number 9439298). When these Terms refer to "we", "our", or "us", they refer to Galaxy Labs Limited.

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services. These Terms apply to both creators (users who create Surveys) and respondents (users who respond to Surveys).

Mapster allows creators to build Surveys, show them to users via an embeddable widget, in-product triggers, or shareable links, attach user attributes to responses, and analyze results in dashboards. By using our Services, you agree to the following:

To create Surveys, you must register an account. Free and paid plans are available as described on our pricing page.

• Provide accurate account information and keep it updated.
• Secure your account credentials; you are responsible for all activities under your account.
• Subscriptions purchased from us are subject to our refund policy (7-day money-back guarantee).
• We may suspend or terminate accounts for violating these Terms or engaging in fraudulent activity.

Renewal, cancellation, and price changes:

• Paid subscriptions renew automatically at the end of each billing period (monthly or annual, as selected at checkout) and are charged to your payment method on the renewal date, until you cancel.
• You can cancel at any time from your account settings or by emailing us. Cancellation takes effect at the end of the current billing period. You keep access to paid features until then, and you are not charged again.
• We do not provide partial refunds for unused time in a billing period, except under our 7-day money-back guarantee or where required by law.
• If we change the price of your plan, we will give you at least 30 days notice by email before the change applies to you. The new price takes effect from your next renewal, and you can cancel before then if you do not want to continue.
• If a payment fails, we may retry it and may suspend access to paid features until payment succeeds. Your data remains available for export during any such suspension.

Lifetime plans purchased through partner marketplaces (e.g., AppSumo, DealFuel):

• A lifetime code unlocks the lifetime plan on one Mapster account. One code per account; codes cannot be stacked or transferred once redeemed.
• "Lifetime" means the lifetime of the Mapster service, not of the purchaser.
• Refunds for marketplace purchases are handled by the marketplace under its own refund policy. If a purchase is refunded, the associated account returns to the free plan.
• Lifetime plans include the paid features as described in the marketplace listing at the time of purchase; we may improve, modify, or replace features over time.

When a respondent answers a Survey, we store the answers together with metadata such as approximate location derived from the IP address, device and browser information, and any user attributes the creator attached. To prevent duplicate and abusive submissions, we store a salted, survey-specific hash of the IP address rather than the raw address, and we apply rate limiting and automated bot checks.

• Creators agree to use Survey data responsibly and only in accordance with their own privacy commitments to their users.
• Creators must not attempt to re-identify respondents who answered anonymously.

Where you use the Services to process personal data that is subject to data protection law, including the EU or UK GDPR, our Data Processing Agreement applies and is incorporated into these Terms by reference. In that arrangement you act as the data controller and we act as your processor. No separate signature is required, though we will provide a countersigned copy on request.

If there is a conflict between the Data Processing Agreement and these Terms, the Data Processing Agreement prevails, but only in respect of the processing of personal data on your behalf.

The Mapster platform, including its design, code, text, and graphics, is protected by intellectual property laws. Unauthorized reproduction, distribution, or use of our platform is prohibited.

• Your Surveys and the response data collected through them remain yours. You grant us the license needed to host, process, and display that data in order to provide the Services.
• You may export your Survey data and use it for any lawful purpose.

Mapster provides the Services "as is" and does not guarantee the accuracy or completeness of Survey results, which depend on voluntary respondent responses.

• We are not liable for disputes arising from Survey content, respondent responses, or user interpretations of data.
• Users are responsible for their content (e.g., Survey questions, shared links, attached user attributes) and must indemnify Mapster against claims related to their use of the Services, including legal fees.
• We are not liable for indirect, incidental, or consequential damages, including loss of profits or data, arising from your use of the Services.
• Our total liability arising out of or in connection with these Terms is limited to the greater of the amounts you paid us in the 12 months before the event giving rise to the claim, or NZ$100.
• Nothing in these Terms excludes, restricts, or modifies any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those laws apply. If you acquire the Services for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply.

While we strive to provide reliable Services, we cannot guarantee uninterrupted access or error-free performance.

• Survey results are illustrative and may not reflect scientific sampling methods.
• We may suspend or modify Services for maintenance, updates, or other operational reasons. For paid plans, we will give reasonable advance notice of any planned interruption or material reduction in functionality, except where an urgent security or stability issue makes that impractical.
• We reserve the right to moderate or remove Surveys that violate these Terms or harm the platform's integrity.

We may suspend or terminate your access to the Services if you violate these Terms, engage in fraudulent activity, or harm the platform or its users.

• You may terminate your account at any time by contacting us or using account settings.
• Export your Survey data before you close your account. After termination we delete your data within 30 days, unless we are required to keep it by law, as described in our Privacy Policy and our Data Processing Agreement.
• Subscription fees are non-refundable except under our refund policy or, for marketplace purchases, the marketplace's refund policy.

We may update these Terms to reflect changes to the Services, our business, or the law. The current version is always posted here with the "Last updated" date revised.

For changes that materially affect your rights or obligations, we will give you at least 30 days notice by email to the address on your account, or by a notice in the product, before they take effect. Other changes take effect when posted.

If you do not agree to a change, you may cancel your account before it takes effect. Continuing to use the Services after that point means you accept the updated Terms.

These Terms are governed by the laws of New Zealand, without regard to conflict of law principles. Any disputes will be resolved in the courts of Auckland, New Zealand, unless otherwise required by applicable law.

For users in the EU or other regions, mandatory local laws may apply, and we will comply with such requirements.
